Equip for Equality, ACLU, Dentons Law File Federal Complaint

Equip for Equality, the federally mandated protection and advocacy agency for individuals with disabilties in Illinois, the American Civil Liberties Union and the Denton's Law firm, filed a federal complaint against the State of Illinois for inadequately funding the 2011 Ligas Consent Decree.

The decree required the state to support the transition of individuals with disabilities out of nursing facilities and to prevent the admission of individuals seeking more independent community living.  Illinois has not provided increases for community providers since 2008 and as a result, the field is experiencing an unprecedented workforce crisis that has created a shortage of direct support professionals needed to support individuals with disabilities in their most independent settings possible. 

The current budget impasse in Illinois, now approaching 24 months, has also contributed to substantial limitations in the growth of needed residential services.  The complaint alleges that the state is not complying with the 2011 decree and is asking the court to force Illinois to provide the resources needed to meet the needs of individuals with disabilities covered under the court order.
